Terms and Conditions
1. About Quick Pesa.
Quick Pesa is a Trade Name of Adtel Communications Limited (herein referred to as Quick Pesa), a company incorporated under the laws of Uganda under registration number 89560. Quick Pesa offers payment aggregation services on behalf of a Seller or Buyer, hence not a financial depository institution.
2. Definitions.
- 2.1 “You” or “you” or “Buyer” or “Customer” is a party who pays for goods, services and or Merchandise through Quick Pesa.
- 2.2 “Seller” or “Merchant” is a party who accepts payments for goods, services and or Merchandise through Quick Pesa.
- 2.3 “Us” or “We” mean the operators of the Quick Pesa services.
- 2.4 “Quick Pesa account” is a party’s details captured during the registration and transaction processing.
- 2.5 “Quick Pesa Credits” are units used to specify the value of a Quick Pesa Token.
- 2.6 “Quick Pesa Token” is a secret code which is used by a buyer to authorize transfer of credits from his /her Quick Pesa account to a sellers Quick Pesa account while paying for goods, services and or Merchandise.
3. Terms and Conditions.
The Terms and Conditions of the Services cover the opening, Use and Closure of the Quick Pesa account. It is a legal contract or agreement between you and Quick Pesa that governs your use of the Quick Pesa services as a buyer or seller of services, goods, or merchandise (herein referred to as products). We therefore highly recommend that you carefully review the Terms and Conditions of the Services before you decide whether to accept the registration or not.
4. Application Requirements.
- 4.1 By registration, you agree that all information supplied when registering for the Quick Pesa services and any other information requested for in order to continue using the service, must be accurate and complete in all respects. In particular, if using a credit or debit card, mobile phone (or SIM card) or mobile money service, the cardholder's name must be the same as the name used when registering for the Quick Pesa Services. Where this is not the case, the relevant account shall be suspended if discovered. Where an account is suspended, the relevant customer shall be notified by Email and in turn he / she should Contact us to resolve the inconsistencies in the supplied information.
- 4.2 All applicants must be over 18 years of age and are capable of entering into a legally binding contract or agreement in order to use the Quick Pesa services. Quick Pesa reserves the right to ask for proof of age, and proof of identity from any customer. And if found not right, Quick Pesa reserves the right to suspend their account until satisfactory documentation is provided.
- 4.3 Quick Pesa may confirm your details by contacting you, requesting for valid documentation or identification in order to verify an account. When such process is initiated, all transaction requests may remain pending until the confirmation is correct.
5. Transactional Terms of Use.
- 5.1 Quick Pesa provides the facilitation for a payment process completion between the buyers and sellers. Quick Pesa stores transactional information from buyers and carries out payment transaction on behalf of the sellers. In order to complete a payment transaction, the buyer must first pay for transaction units called credits which he/she then uses to create an electronic token that is accepted by the seller’s website or Point of Sale as a means of payment. The buyer authorizes the transfer of some or all of his/her credits to the seller by supplying his/her Token at the seller’s website or Point of Sale. If suspicious transactions arise, especially those which violate the applicable laws, fraud rules, terms of services for the buyers and sellers, and or Quick Pesa policies, then we may delay or suspend the payment transaction as determined in Quick Pesa’s sole and absolute discretion.
- 5.2 You acknowledge and agree that buying and selling of products is a transaction between the buyer and the seller, and not with Quick Pesa. Quick Pesa is not a party to the buying and selling of products, and Quick Pesa is not a buyer or seller of products as far as any payment transaction is concerned, unless expressly stated in the list of the Products on the Quick Pesa’s Web Site.
6. Transactional Limitations of Use and Warrant.
- 6.1 Quick Pesa reserves the rights to restrict, suspend, change, and or stop any of its services, this may include any of the service package, service availability, new customer enrollment, operational hours, impose limits on all or part of the services, and or restrict accessibility to parts or all of the Services without prior notice and liability.
- 6.2 Quick Pesa does not warrant that the its Services shall not be uninterrupted or error free, and we shall not be responsible for any service interruptions especially, but not limited to, power outages, system failures or other interruptions that may affect the transactional settlement processes. We may restrict or suspend your use of the Service at any time, in our sole and absolute discretion. And if this happens that we suspend your use of the Services, and in due respect we shall attempt to notify you by electronic mail (E-mail).
7. User Responsibility.
You accept to carry the responsibility of maintaining the confidentiality of your usernames and passwords for both the Quick Pesa account and the associated Email(s) of use for the Quick Pesa services. You will be responsible for any or all transactions by the persons that you have given access to or that otherwise use such usernames or passwords. You will also be responsible for any or all consequences of use or misuse of your usernames and passwords. You agree to notify us immediately of any unauthorized use of your associated usernames or passwords or any other breach of security regarding Quick Pesa Services of which you are aware of or have knowledge.
8. Privacy Policy.
By using Quick Pesa services, you understand and agree that personal information provided to us is subject to the Quick Pesa’s Privacy Policy.
9. Quick Pesa Service Charges.
You acknowledge and agree that we may charge a fee set by us for some services offered by Quick Pesa as it may deem necessary. All charges shall be in form of credits that you purchase from us.
10. Disputes and Customer Protection.
In case a dispute arises regarding a transaction conducted through Quick Pesa, We encourage the buyer and the seller to first communicate with each other and try to resolve the conflict. In case the buyer and the seller do not reach an understanding, the buyer and the seller may report the conflict in our online conflict resolution center. We reserve the right to intervene and try to resolve the conflict, and we may at our sole and absolute discretion reverse the transaction and have credits returned to the buyer’s Quick Pesa account from the Seller’s Quick Pesa account if it is deemed necessary.
11. Termination of Service Use.
Quick Pesa, in her sole and absolute discretion without liability to you or any third party, may terminate your use of the Quick Pesa Services for a sound reason, including; inactivity or violation of these Terms of Service or other policies which may be established from time to time. Upon termination of use of Quick Pesa services, you remain liable for all Payment Transactions and any other obligations you incurred while using Quick Pesa services. Upon termination, Quick Pesa reserves the right to prohibit or restrict your access to the Quick Pesa Services, and these include deactivation of your Quick Pesa account, and deny you future access to Quick Pesa Services.
12. Products Responsibility
The products are not a responsibility of Quick Pesa and we do not endorse or represent or take care, and we will not be in charge for the safety, accuracy, quality, reliability, integrity or legality of any Product, the validity or truth or accuracy of the Products’ description, or of any advice, opinion, offer, proposal, statement, data or other information which may be collectively displayed or distributed, purchased or paid for through the Quick Pesa Services. The ability of Buyer to buy Products or Seller to deliver Products is not a responsibility of Quick Pesa. Quick Pesa hereby disclaims any liability or responsibility for errors or omissions in any Content of the products.
13. Limitations of Liability; Force Majeure
Quick Pesa will not be liable to the buyer or seller in the event of any disruption of the Quick Pesa Services or any part thereof resulting from Force Majeure and Quick Pesa may suspend the Service or part thereof in such an event. Force Majeure for purposes of this Terms of Service means any situation or event that makes it impossible for Quick Pesa to perform its obligations and includes, but is not limited to any act of natural calamity such as lightening, floods, earthquakes, prohibitive decisions made by the nature, government, local authority, civil war conflict, and or industrial strikes as well as any global or partial dysfunction of the Service caused by disruption or suspension of the telecommunication or internet facilities.
14. Jurisdiction; Governing Law.
The Terms of Service shall be governed in all aspects in accordance with the Laws of Uganda and a court of complete jurisdiction in Uganda shall determine every claim or dispute arising out of or in connection with this Terms of Service as far as Quick Pesa is concerned.
15. Changes in Terms of Service for the user.
Quick Pesa has the right, in her sole and absolute discretion, to change, modify, or amend any portion of this Terms of Service at any time by posting notification on Quick Pesa Web Site or otherwise communicating the notification to you by the available means. The changes will become effective, and shall be deemed accepted by you, after the initial posting and will apply on a going-forward basis with respect to Payment Transactions initiated after the posting date. In the event that you do not agree with any such modification, your sole and exclusive remedy is to terminate the use of the Quick Pesa services.
